A Defesa do Superior Interesse da Criança nas Comissões de Proteção de Crianças e Jovens da CIM-Região de Coimbra: desafios, boas práticas e perspetivas de melhoria

| dc.description.abstract | A promoção dos direitos e proteção das crianças e jovens constituem pilares fundamentais para uma sociedade justa e inclusiva. Em Portugal, este trabalho é assegurado em grande parte pelas Comissões de Proteção de Crianças e Jovens (CPCJ). Esta dissertação tem como objetivo geral analisar o trabalho dos membros das CPCJ da Comunidade Intermunicipal (CIM) da Região de Coimbra na promoção e proteção dos direitos das crianças e jovens, avaliando os principais desafios e constrangimentos enfrentados na concretização do princípio do Superior Interesse da Criança. O instrumento de recolha de dados utilizado foi um questionário estruturado com questões abertas, aplicado às CPCJ da CIM- Região de Coimbra, na modalidade restrita, por via eletrónica, através de um formulário digital criado na plataforma Google Forms (https://docs.google.com/forms), cuja informação foi transferida para Excel. A análise realizada evidenciou vários constrangimentos no funcionamento das CPCJ. No plano organizacional, destacam-se a falta de profissionalização e de tempo de afetação dos membros, a insuficiência de recursos humanos, administrativos e materiais, bem como a ausência de formação contínua e a elevada rotatividade dos comissários, o que dificulta a articulação entre entidades. Na intervenção técnica, surgem como principais desafios a escassez de recursos e tempo, a sobrecarga de trabalho, a burocracia processual, fragilidades na articulação interinstitucional e desafios no trabalho com as famílias, nomeadamente resistência, baixa colaboração e compreensão limitada do papel das CPCJ. No domínio da formação, verificam se dificuldades de acesso e de natureza logística, insuficiente oferta formativa e inadequação dos conteúdos e modelos de formação, marcados por reduzida aplicabilidade prática, escassez de módulos avançados e necessidade de maior flexibilidade, incluindo modalidades online e oportunidades de partilha entre comissões. Apesar do papel essencial das CPCJ, persistem limitações estruturais e operacionais que dificultam a eficácia da intervenção, como a escassez de recursos humanos, a rotatividade e a insuficiência de respostas sociais. O reforço das Comissões exige valorização das equipas, articulação interinstitucional e formação contínua. A proteção das crianças não pode depender do esforço individual dos profissionais; apenas uma abordagem sistémica, sustentada e continuada garante respostas eficazes e o cumprimento do superior interesse da criança. | The promotion of the rights and protection of children and young people are fundamental pillars for a fair and inclusive society. In Portugal, this work is largely ensured by the Commissions for the Protection of Children and Young People (CPCJ). The main objective of this dissertation is to analyze the work carried out by members of the CPCJ in the Intermunicipal Community (CIM) of the Region of Coimbra to promote and protect the rights of children and young people, assessing the main challenges and constraints faced in the implementation of the principle of the Best Interests of the Child. The data collection instrument used was a structured questionnaire with open-ended questions, applied electronically to intervention team members (restricted modality) at the CPCJ of CIM Coimbra, using a digital form created on the Google Forms platform (https://docs.google.com/forms), and subsequently transferred to Excel. The analysis carried out highlighted several constraints in the functioning of the CPCJ. At the organizational level, the main issues identified were the lack of professionalization and dedicated time of members, insufficient human, administrative and material resources, along with the absence of continuous training and the high turnover of commissioners, which hinders coordination between entities. In terms of technical intervention, the main challenges include limited resources and time, excessive workload, procedural bureaucracy, weaknesses in inter institutional coordination, and challenges when working with families, namely resistance, low collaboration and a limited understanding of the role of the CPCJ. With respect to training, issues were found relating to access and logistics, insufficient training opportunities and inadequacy of content and training models, characterised by limited practical applicability, a shortage of advanced modules and the need for greater flexibility, including online modalities and opportunities for knowledge sharing between commissions. Despite the essential role of the CPCJ, there are persistent structural and operational limitations, such as the lack of human resources, turnover and insufficient social responses, that hinder the effectiveness of their intervention. Measures to strengthen the Commissions requires valuing teams, inter-institutional coordination and continuous training. The protection of children cannot depend on the individual effort of professionals; only a systemic, evicence-based and continuous approach can ensure effective responses and the fulfilment of the best interests of the child. | |
